Quick answer: On Oct. 30, 2026, CFTC Chairman Michael Selig told CNBC that Binance’s roughly $6.3 billion hack ‘proves our exact point’ and pitched voluntary CFTC offshore exchange registration with U.S.-style cybersecurity rules. Public comments on the CFTC’s retail crypto proposal close on Dec. 14, 2026.

CFTC offshore exchange registration moved from a quiet rulemaking topic to a headline on Oct. 30, 2026. One day after Binance lost an estimated $6.3 billion in the largest theft crypto has seen, CFTC Chairman Michael Selig said the attack “proves our exact point.”

Speaking to CNBC, Selig said the U.S. regulator wants to give offshore platforms like Binance a federal option to register and accept the same cybersecurity safeguards that apply to U.S. markets. The window to shape those rules closes on Dec. 14, 2026.

What did the CFTC chair say about the Binance hack?

Selig framed the breach as a problem of unregulated venues, not of blockchains. “The real issue here is that these are unregulated offshore exchanges, and they don’t have the same sorts of safeguards that we have in our financial markets here in the U.S.,” he said, as quoted by Stocktwits.

He also added: “We want to offer a federal option to these exchanges to come and register with the CFTC, and they would be subject to the same sorts of cybersecurity safeguards that we have in our markets today.”

In addition, Selig said public ledgers give investigators “a very good shot” at tracing the stolen coins, even if the attackers use mixers such as Tornado Cash. He said the CFTC will help law enforcement with the case.

How big was the Binance hack?

Binance was drained on Oct. 29, 2026, in roughly 20 minutes, according to Crypto Briefing. The estimated $6.3 billion loss is about four times the previous record, the $1.5 billion Bybit theft in 2025.

Partners froze around $3 billion of the stolen funds, and Binance says it will cover customer losses from its SAFU fund and company reserves of more than $6.34 billion. Blockchain analysts have tied the attack to North Korea’s TraderTraitor group. We covered the attribution in our Binance hack North Korea report and the early freeze in Binance’s $2.54 billion freeze update.

Would CFTC offshore exchange registration be mandatory?

No. Selig said the CFTC does not have the power to force every crypto exchange to register; that would take an act of Congress, Bloomingbit reported. Instead, what the agency can do is offer an opt-in federal regime.

There is one important line, though. Under the Commodity Exchange Act, retail crypto trading that involves margin, leverage or financing already falls under CFTC jurisdiction. That is the slice the new framework targets, and it is where offshore venues earn much of their fee revenue.

What rules come with CFTC offshore exchange registration?

The plan builds on an advance notice of proposed rulemaking the CFTC announced on Oct. 5, 2026. It was published in the Federal Register on Oct. 13 as 91 FR 64811, under the title “Regulation Crypto Asset Transactions and Regulation Crypto Asset Markets.”

The notice proposes a new “crypto asset market” category of designated contract market, built for leveraged retail crypto trades. According to Bloomingbit’s account of Selig’s remarks, the rules would cover:

  • protection against market manipulation and fraud
  • segregated custody of customer assets
  • separation of broker, exchange and clearing functions
  • cybersecurity safeguards similar to those in U.S. markets

Still, this is an early step. An advance notice gathers comments before the agency writes actual rule text, so a final rule would come later. As a result, timing for actual registrations is still unclear.

What does this mean for crypto markets?

For now, little changes for traders. Binance and other offshore venues are not required to sign up, and no registered “crypto asset market” exists yet.

The bigger signal is direction. The CFTC is using the record hack to argue that U.S. oversight is a selling point, not a threat. Exchanges that want access to U.S. retail leverage could see registration as a badge of safety after this week. However, others may stay away to avoid custody and separation rules that would reshape how they operate.

Regulation has been busy this month, from Utah’s Kalshi charges to the CFTC’s perpetual futures court fight. Meanwhile, market mood is fragile, with Bitcoin heading for its worst October since 2014. You can track BTC on our Bitcoin price page.

CFTC Offshore Exchange Registration FAQ

What is CFTC offshore exchange registration?

It is a proposed voluntary path that would let non-U.S. crypto exchanges register with the Commodity Futures Trading Commission. Registered venues would follow U.S.-style rules on cybersecurity, customer asset segregation and fraud prevention, according to CFTC Chairman Michael Selig on Oct. 30, 2026.

Does Binance have to register with the CFTC?

No. Selig said the CFTC cannot make registration mandatory for every exchange without new law from Congress. The proposal is an opt-in federal option, although leveraged retail crypto trading already falls under CFTC jurisdiction.

When is the deadline to comment on the CFTC crypto proposal?

Comments on “Regulation Crypto Asset Transactions and Regulation Crypto Asset Markets” (91 FR 64811) are due by Dec. 14, 2026. They can be filed through Regulations.gov or the Federal Register comment form.

How much did hackers steal from Binance?

About $6.3 billion was drained on Oct. 29, 2026, the largest crypto theft on record. Around $3 billion was frozen, and Binance says it will cover user losses from its SAFU fund and reserves.
